SECOND SHOOTER & ASSOCIATE SHOOTER AGREEMENT

Thank you for your interest in becoming a Second Shooter for Ed Brown Photography & LOVELY CREATURES. Ed and Victoria are proud of their friendly and relaxed approach and this is the only time you will have to sign this form which clearly outlines what we expect from our second shooters.

PARTIES

(1) Ed and Victoria of Ed Brown Photography & LOVELY CREATURES, Studio G004, The Atkins Building, Lower Bond Street, Hinckley Leicestershire, LE10 1QU.

(2) Second shooter name will be entered into the form at the bottom of the agreement ("You")


Below are the terms and conditions on which Ed & Victoria shall book you to assist them in the provision of photography services.

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Ed, Victoria and You, in writing and signed by the parties.

BOOKINGS

Bookings are usually initially agreed upon verbally, but then followed up in writing/email. On confirmation of a booking, the following shall be agreed: Date(s), start time(s), and hours; Location and travel arrangements; Fee and payment details; Special arrangements with the client.

Nothing in this Agreement shall be construed as creating an employer/employee relationship, as a future employment or engagement guarantee, or as a limitation upon Victoria and Ed's sole discretion to terminate this Agreement at any time without cause you agree to be responsible for your own taxes, insurance, and all other benefits.



FEES AND PAYMENT TERMS

Victoria Ed shall pay you no later than 30 days after the wedding date unless otherwise agreed at the time of the booking.

You shall provide Ed with an invoice for your fee in advance of the payment and the invoice shall contain the following information: Your name and home address, Invoice number, Fee, Date, VAT Number (if VAT registered)

CANCELLATION AND POSTPONEMENT

Cancellation is not ideal, however, we know things may occur. If you are unable to attend through obtaining your own booking you must give at least 14 days notice for us to find a suitable replacement.

If you are ill please ensure that you give notice as soon as possible so another Second Shooter can be found, it is your responsibility to ensure that if you cannot contact us that a family member/emergency contact does so on your behalf.

Non-attendance will result in no monies being paid to you.

If Victoria and Ed's booking with their client is cancelled then regrettably this agreement will terminate too without payment to You.

COPYRIGHT LICENCE AND MORAL RIGHTS

Ed & Victoria may like to use the photographs you take on the shoot to promote his own business.

In consideration of the sum of the Fee referred to in Fees and Payment Terms, you assign to Victoria and Ed absolutely the following rights throughout the world the entire copyright and all other rights in the nature of copyright subsisting in the photographs you take during the shoot for the whole term including any renewals, reversions, revivals and extensions and together with all related rights and powers arising or accrued, including the right to bring, make, oppose, defend, appeal and obtain relief (and to retain any damages recovered) in respect of any infringement, or any other cause of action arising from the ownership, of any of these assigned rights, whether occurring before, on or after the date of this agreement.

You, being the sole author of the photographs you take on the shoot, waive all moral rights in respect of the use to be made of your photographs by Ed under this agreement to which You may now or at any future time be entitled under the Copyright, Designs and Patents Act 1988 or under any similar legislation from time to time in force anywhere in the world. This waiver is for the benefit of Victoria and Ed, their licensees, assignees and their successors in business.

IMAGE USAGE

1. Images are not to be used by the second photographer, either for portfolio, website, social media or for commercial use or any other use such as printed albums, promotional material or slideshows. Essentially these belong to Ed Brown Photography and so does the copyright of said images.

ETIQUETTE

1. Be personable, friendly, approachable and unobtrusive - our company takes pride in our friendly approach.

Please Note: That whilst working under the Ed Brown Photography brand our approach is unobtrusive and documentary, as our clients love to enjoy the day with their friends and family.

We expect our second shooters to also photograph lots of details and abstract images as well as documentary emotive moments, however, if asked by the client or guests for a portrait or group these are expected to be taken also.

As we are primarily documentary wedding photographers in approach please capture moments as they happen instead of helping with buttonholes, cravats etc as these can provide excellent documentary opportunities.

Again as primarily documentary wedding photographers please remain as unobtrusive as possible as much as possible.


2. We positively encourage individuality but please dress with respect for our client - we don't expect you to arrive in your finest Paul Smith suit. Converse, jeans and casual shirts are perfect. We are a brand of inclusivity and equality so please no offensive slogans or references. In short, just be you and if in doubt ask.

3. Abusive/ Offensive/ Inappropriate language or behaviour will not be tolerated.

4. You will not advertise your own business, will not solicit work for yourself and only distribute Victoria & Ed's promotional material, business cards and name.

5. You will not contact/friend the client via social media or otherwise after the event. Contact made by the client should be re-directed to Victoria & Ed.

6. You will not advertise your own business/website / Facebook / social media accounts / Business name through conversation, business cards or in any other way whilst you are working under the Ed Brown Photography & LOVELY CREATURES brands

CONFIDENTIALITY

You understand that all materials, price lists, contracts, financial documents, agreements, and other information or documents that are given to you in the scope of your assignments are the exclusive property of Ed Brown Photography & LOVELY CREATURES and are privileged and confidential information.

THE LAW

This agreement shall be governed by the laws of England & Wales.



ACCEPTANCE

By receiving monies from Ed Brown Photography & LOVELY CREATURES and/or filling in your details below you agree to all the terms outlined in this second shooter agreement.
